1. Acceptance of Terms

By accessing or using WriteTutor.ai, you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the service. These Terms of Service apply to all visitors, users, and parents who access or use WriteTutor.ai.

WriteTutor.ai provides an AI-guided writing education platform specifically designed for children in grades 4-6. Parents must create accounts and provide consent for their children to use the service in compliance with the Children's Online Privacy Protection Act (COPPA).

2. Account Registration and Parental Responsibility

Parents must create and manage accounts for their children. By creating an account, you certify that all information provided is accurate and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

As a parent or legal guardian, you are responsible for:

• Creating and managing your child's profile
• Providing accurate information about your child, including name and grade level
• Supervising your child's use of WriteTutor.ai
• Reviewing your child's creative writing and ensuring it aligns with your family's values and our platform guidelines

3. Subscription and Payment Terms

WriteTutor.ai offers a subscription-based service at $24.99 per month with unlimited tutoring sessions. We also offer a free trial that includes 2 narrative writings at no charge.

• Free Trial: New users may be eligible for a free trial. No credit card is required for the free trial, which provides access to 2 narrative writings.
• Subscription: After any applicable free trial, subscriptions are billed monthly at the rate specified at the time of purchase.
• Automatic Renewal: Subscriptions automatically renew each month until cancelled.
• Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of the current billing period.
• Refunds: Except as required by law, subscription payments are non-refundable.

4. Content and Conduct Guidelines

WriteTutor.ai is designed to provide a safe, educational writing environment for children. The following guidelines apply:

• All content created by children must be appropriate for elementary and middle school students.
• Content should be age-appropriate writing including stories and essays. While stories may contain fictional adventures, fantasy elements, or mild conflict typical of children's literature, content must not contain excessive profanity, hate speech, real threats against actual people, sexually explicit material, or content that promotes illegal activities.
• Parents are responsible for reviewing and monitoring their child's creative content and determining what is appropriate for their family.
• WriteTutor.ai reserves the right to modify, reject, or remove any content that violates these guidelines.
• Users must not attempt to use the platform to communicate with other users or share personal information.
• The service must not be used for any illegal or unauthorized purpose.

5. Intellectual Property

WriteTutor.ai and its contents, features, and functionality are owned by WriteTutor AI LLC and are protected by copyright, trademark, and other intellectual property laws.

Content created by children using WriteTutor.ai:

• Stories, essays, and other writing content created by your child using WriteTutor.ai belong to you and your child.
• By using our service, you grant us a non-exclusive, royalty-free license to store, process, and analyze this content to provide and improve our services.
• We may use anonymized, aggregated data derived from user content for product improvement and research purposes.
• We will not publish, sell, or distribute your child's writing content to third parties without your consent.

6. Data Use and Privacy

Our use of your child's personal information is governed by our Privacy Policy and applicable data protection laws, including COPPA. Please review our Privacy Policy for details on how we collect, use, and protect your child's information.

7. Disclaimers and Limitations of Liability

WriteTutor.ai is provided "as is" and "as available" without any warranties of any kind. We do not guarantee that the service will be uninterrupted, timely, secure, or error-free.

To the maximum extent permitted by law, WriteTutor AI LLC disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

WriteTutor AI LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, resulting from your use or inability to use the service, unauthorized access to or alteration of your transmissions or data, or any other matter relating to the service.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages, so some of the limitations in this section may not apply to you.

8. Termination

We may terminate or suspend your account and access to WriteTutor.ai immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the service will cease immediately. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

9. Modification of Terms

We reserve the right to modify these Terms of Service at any time. We will provide notice of significant changes by posting the updated Terms on our website and/or sending an email to the address associated with your account.

Your continued use of WriteTutor.ai after any changes to the Terms constitutes your acceptance of the revised Terms. If you do not agree to the new terms, please stop using the service.
